before ordering any product from The Mystic Voodoo. The Mystic Voodoo
Web Site (the "Site") is an online information service and mystical art website
provided by The Mystic Voodoo ("The Mystic Voodoo "), subject to your compliance
with the terms and conditions set forth below. PLEASE READ THIS DOCUMENT
CAREFULLY BEFORE ACCESSING OR USING THE SITE. BY ACCESSING OR USING THE
SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW.
IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS
OR USE THE SITE. The Mystic Voodoo MAY MODIFY THIS AGREEMENT AT ANY TIME,
AND SUCH MODIFICATIONS SHALL BE EFFECTIVE IMMEDIATELY UPON POSTING OF THE
MODIFIED AGREEMENT ON THE SITE. YOU AGREE TO REVIEW THE AGREEMENT
PERIODICALLY TO BE AWARE OF SUCH MODIFICATIONS AND YOUR CONTINUED ACCESS OR USE
OF THE SITE SHALL BE DEEMED YOUR CONCLUSIVE ACCEPTANCE OF THE MODIFIED
AGREEMENT.
1. Copyright, Licenses, and Idea Submissions
The entire contents of the site
are protected by international copyright and trademark laws.
The owner of the copyrights and trademarks
are The Mystic Voodoo, its affiliates or other third party licensors. YOU MAY
NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE,
IN ANY MANNER, THE MATERIAL ON THE SITE, INCLUDING TEXT, GRAPHICS, CODE AND/OR
SOFTWARE. You may print and download portions of material from the different
areas of the Site solely for your own non-commercial use provided that you agree
not to change or delete any copyright or proprietary notices from the materials.
You agree to grant to The Mystic Voodoo a non-exclusive, royalty-free,
worldwide, perpetual license, with the right to sub-license, to reproduce,
distribute, transmit, create derivative works of, publicly display and publicly
perform any materials and other information (including, without limitation,
ideas contained therein for new or improved products and services) you submit to
any public areas of the Site (such as bulletin boards, forums and newsgroups) or
by e-mail to The Mystic Voodoo by all means and in any media now known or
hereafter developed. You also grant to The Mystic Voodoo the right to use your
name in connection with the submitted materials and other information as well as
in connection with all advertising, marketing and promotional material related
thereto. You agree that you shall have no recourse against The Mystic Voodoo for
any alleged or actual infringement or misappropriation of any proprietary right
in your communications to The Mystic Voodoo.

Publications, products, content
or services referenced herein or on the Site are the exclusive trademarks or
service marks of The Mystic Voodoo. Other product and company names mentioned in
the Site may be the trademarks of their respective owners.
2. Use of the Site.
You understand that, except for
information, products, or services clearly identified as being supplied by The
Mystic Voodoo, The Mystic Voodoo does not operate, control, or endorse any
information, products, or services on the Internet in any way. Except for The
Mystic Voodoo- identified information, products or services, all information,
products and services offered through the Site or on the Internet generally are
offered by third parties, that are not affiliated with The Mystic Voodoo. You
also understand that The Mystic Voodoo cannot and does not guarantee or warrant
that files available for downloading through the Site will be free of infection
or viruses, worms, Trojan horses or other code that manifest contaminating or
destructive properties. You are responsible for implementing sufficient
procedures and checkpoints to satisfy your particular requirements for accuracy
of data input and output, and for maintaining a means external to the Site for
the reconstruction of any lost data.
YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR

INTERNET GENERALLY, AND The Mystic Voodoo SHALL NOT BE LIABLE FOR ANY COST OR
DAMAGE ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY SUCH TRANSACTION. IT IS
SOLELY YOUR RESPONSIBILITY TO EVALUATE THE ACCURACY, COMPLETENESS, AND
USEFULNESS OF ALL OPINIONS, ADVICE, SERVICES, MERCHANDISE, AND OTHER INFORMATION
PROVIDED THROUGH THE SERVICE OR ON THE INTERNET GENERALLY. The Mystic Voodoo
DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT
DEFECTS IN THE SERVICE WILL BE CORRECTED.
YOU UNDERSTAND FURTHER THAT THE PURE NATURE OF
THE INTERNET CONTAINS UNEDITED MATERIALS SOME OF WHICH ARE SEXUALLY EXPLICIT OR
MAY BE OFFENSIVE TO YOU. YOUR ACCESS TO SUCH MATERIALS IS AT YOUR RISK. The
Mystic Voodoo HAS NO CONTROL OVER AND ACCEPTS NO RESPONSIBILITY WHATSOEVER FOR
SUCH MATERIALS.
3. Disclaimer
All items are sold as curios only and are for
entertainment purposes only. You must be 18 years of age or older to purchase
items from The Mystic Voodoo or obtain parental consent. We cannot guarantee
results nor take any responsibility for the outcome of using magical products.
The Mystic Voodoo makes no warranty regarding the operation of the website, home
studio, or any information or other content on it or in the home studio
location, on any service or products provided through or in connection with the
website and/or home studio location. The Mystic Voodoo expressly disclaims any
and all warranties and refunds, express or implied by including, but not limited
to any warranties as to the availability, products, content, accuracy,
completeness, or information which are part of the website and home studio
location. Any and all benefits received from the use of our magickal products
will be variable and based on the faith and conviction of the believers. By
purchasing The Mystic Voodoo services and/or products you agree to and accept
this disclaimer.
You are encouraged to use any and all products
purchased from the Mystic Voodoo responsibly.
The Mystic Voodoo adheres to a very strict damage
and hate policy within the website and home studio location. Anyone who engages
in any damaging, slanderous activity about The Mystic Voodoo, any of its
vendors, suppliers, employees, or material contained within will be prosecuted
to the fullest extent of the law. Further, any physical damage caused to the
home studio location, or public slander that negatively impacts our reputation
either on the World Wide Web or in the home studio location will be pursued
legally and financially, and the individual or individuals responsible for said
damage will be responsible to compensate The Mystic Voodoo for said damages.
LIMITATION OF LIABILITY
IN NO EVENT WILL The Mystic Voodoo BE LIABLE
FOR (I) ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT
LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS
OR INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE
WEBSITE, OR ANY INFORMATION, OR TRANSACTIONS PROVIDED ON THE SERVICE, OR
DOWNLOADED FROM THE WEBSITE, OR ANY DELAY OF SUCH INFORMATION OR SERVICE, EVEN
IF The Mystic Voodoo OR ITS AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES, OR (II) ANY CLAIM ATTRIBUTABLE TO ERRORS,
OMISSIONS, OR OTHER INACCURACIES IN THE WEBSITE AND/OR MATERIALS OR INFORMATION
DOWNLOADED THROUGH THE WEBSITE OR HOME STUDIO LOCATION. BECAUSE SOME STATES DO
NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR
INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES,
The Mystic Voodoo LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
The Mystic Voodoo makes no representations
whatsoever about any other web site which you may access through this one or
which may link to this Site. When you access a non-The Mystic Voodoo web site,
please understand that it is independent from The Mystic Voodoo, and that The
Mystic Voodoo has no control over the content on that web site. In addition, a
link to a The Mystic Voodoo web site does not mean that The Mystic Voodoo
endorses or accepts any responsibility for the content, or the use, of such web
site.
4. Indemnification
You agree to indemnify, defend
and hold harmless The Mystic Voodoo, its officers, directors, employees, agents,
licensors, suppliers and any third party information providers to the Service
from and against all losses, expenses, damages and costs, including reasonable
attorneys' fees, resulting from any violation of this Agreement (including
negligent or wrongful conduct) by you or any other person accessing the Service.
5. Third Party Rights.
The provisions of paragraphs 2
(Use of the Service), and 4 (Indemnification) are for the benefit of The Mystic
Voodoo and its officers, directors, employees, agents, licensors, suppliers, and
any third party information providers to the Service. Each of these individuals
or entities shall have the right to assert and enforce those provisions directly
against you on its own behalf.
6. Refunds, Returns, and Exchanges
Due to the nature of our handcrafted and
ritualized products, there can be no refunds after an order is placed,
unless we are notified within 24 hours of the initial
placement of the order. This applies whether or not you have changed your
mind: your order cannot be cancelled or refunded. Once the creation of your
items begins, they are created for you and cannot be sold to anyone else. We are
guided by proper magick and Voodoo hoodoo protocol that has been passed down for
centuries by responsible practitioners. Therefore, all magickal Voodoo hoodoo
products from The Mystic Voodoo cannot be exchanged, returned, refunded, or
revised in any way.
Due to the nature of our handcrafted and
ritualized products, we cannot accept any returns or exchanges on any product
after order and delivery, so please choose your products carefully. This applies whether
you have changed your mind for any reason; your items cannot be returned to The
Mystic Voodoo. Since there is no way of verifying what has happened to our
products once they have left our possession, it is not appropriate to pass on
magickal items to someone else once it has been used. We are guided by proper
magick and Voodoo hoodoo protocol that has been passed down for centuries by
responsible practitioners. Therefore, all magickal Voodoo hoodoo products from
The Mystic Voodoo cannot be exchanged, returned, refunded, or revised in any
way.
This does not apply to items shipped in error.
Please notify us within 72 business hours
upon receipt. You may ship it back to us for a full exchange, providing it is
returned to us unaltered. If it appears altered upon arrival, we will notify you
of the reason it cannot be exchanged by email and the item will not be returned
or exchanged. By purchasing The Mystic Voodoo services and/or products you agree
to and accept this term.
If the item is unaltered, we will priority ship
your correct product out immediately at our expense. Again,
customers have 72 business hours (3 business
days) to notify us of the error. If we do not receive
notification of the shipping error within this time frame we will not honor the
exchange. To notify us of the error, you must email
customerservicefairy@mysticvoodoo.com with your product information
and delivery date and we will priority ship your correct product out immediately
at our expense.
We take extraordinary care in packing each
order with plenty of secure shipping supplies and we have never received a
complaint of any item arriving broken. In the few event this has occurred, it
has been the sole responsibility of the USPS for careless handling of your
package, therefore, should anything break during shipping, you
MUST FILE A CLAIM
with the USPS. This means, you will have to take your package to your
local post office for them to examine the damage they caused. We are NOT
RESPONSIBLE for any damage caused by the USPS. Once the package leaves our hands
and after inspection by the USPS for secure shipping guidelines, it is no longer
under our control and you must deal with the USPS. This is why all of our orders
are insured, the cost of which is calculated in the total shipping cost.
7. Notifications
The Mystic Voodoo strives to provide accurate and
reliable information on this website. The information and sources are obtained
from those trained or disciplined in our spiritual tradition(s), sound academic
sources, as well as ancient sacred texts that we believe to be reliable. The
information, however, cannot be guaranteed as 100% accurate. There may be
technical inaccuracies or typographical errors on the website. Any life decision
you make as a result of reading anything on this website or as a result of any
product or service purchased is your responsibility and not the responsibility
of The Mystic Voodoo.
The Mystic Voodoo reserves the right to alter,
remove, include, expand, adjust and revise all products lines, content,
formulary, ingredients, pricing and make changes to the website or retail store
products described therein at any time without notice. Should there be any
revisions to the materials contained within, they are still subject to the
Copyright and Trademarks laws and polices in affect.
The Mystic Voodoo reserves the right to deny
services and products and all materials contained within the website and home
studio location without notice at any time. Further we reserve the right to deny
entry into our home studio location without prior notification.
The Mystic Voodoo cannot guarantee the security
of transmitting data through any servers or the World Wide Web; therefore, we
cannot determine with absolute certainty the privacy of your transmissions,
terminal, programs, or gateway when accessing our website and the contents
contained therein. We do not consider any data to be private nor inaccessible
when we are the recipient of digital transmissions.
8. General
This site is owned and maintained by Denise
Alvarado located in Prescott Valley, Arizona in the United States of America and all
parties are subject to the laws of the United States. If any dispute arises out
of this agreement, then all parties agree that any dispute will be resolved
within the jurisdiction of the State of Iowa and must be brought to a state or
federal court within the State of Iowa. Any and all disputes must be brought to
the agreed upon venues within the State of Iowa within one year of written
notification of dispute. Further all parties agree that to access this site from
outside the United States is done on your own behalf and you are responsible for
compliance with United States local, state, or federal laws. If any part of this
Agreement is determined to be invalid or unenforceable pursuant to applicable
law including, but not limited to, the warranty disclaimers and liability
limitations set forth above, then the invalid or unenforceable provision will be
deemed superseded by a valid, enforceable provision that best matches the intent
of the original provision and the remainder of the Agreement shall continue in
effect. By purchasing any product or services from The Mystic Voodoo website or
home studio location, you have agreed and accept the governing jurisdiction laws
and validity of all disclaimers and policies contained within.
Any rights not expressly granted herein are
reserved.
